Terms of Service
Last updated: October 9, 2026
1. Acceptance of terms
By creating an account or using DiningMetrics ("the Service"), you agree to these Terms of Service. If you use the Service on behalf of a restaurant or company, you represent that you have authority to bind that business to these terms. If you do not agree, do not use the Service.
2. What the Service does
DiningMetrics is a mobile-first web app for restaurant weekly operations: entering revenue, labor, invoices, and inventory counts; calculating cost of consumed goods (beginning inventory + purchases − ending inventory) and prime cost; and comparing results against monthly budgets. The Service is a reporting and bookkeeping aid — it does not replace your accounting system, point-of-sale system, or professional advice.
3. Accounts and eligibility
You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. Minimum age to use the Service is 18. You may invite team members; you remain responsible for their use of the account.
4. Demo mode
The Service offers an interactive demo populated with fictional restaurant data. Demo mode is provided "as is" for evaluation only. Data entered in demo mode is stored in your own browser and never synced to our servers or shared with anyone. We may change or remove demo content at any time.
5. Your data
You retain all rights to the operational data you enter (revenue, invoices, inventory counts, budgets, and similar records). You grant us a limited license to store and process that data solely to operate and support the Service. You are responsible for the accuracy of the data you enter and for maintaining your own backups of records you cannot afford to lose. See ourPrivacy Policy for how we handle personal data.
6. Acceptable use
You agree not to: misuse or attempt to disrupt the Service; access data belonging to other customers; reverse engineer the Service except where prohibited by law; resell or sublicense the Service without written permission; or use it for any unlawful purpose.
7. Fees and billing
If you subscribe to a paid plan, you agree to pay the fees stated at sign-up, billed in advance. Fees exclude applicable taxes, which you are responsible for. Subscriptions renew automatically until cancelled. Except where required by law, fees already paid are non-refundable.
8. Availability and changes
We aim for high availability but do not guarantee uninterrupted service. We may add, change, or remove features, and may modify these terms. Material changes will be communicated through the Service or by email; continued use after changes take effect constitutes acceptance.
9. Disclaimers and limitation of liability
The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that calculations, reports, or exports will be error-free or fit for any particular purpose — verify critical figures before relying on them. To the maximum extent permitted by law, our total liability arising from the Service is limited to the fees you paid us in the twelve months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data.
10. Termination
You may cancel at any time. We may suspend or terminate accounts that violate these terms or remain unpaid. On request following termination, we will make your operational data available for export for a reasonable period before deletion.
11. Governing law
These terms are governed by the laws of the State of Illinois, USA, without regard to conflict of law principles.
